WOW!
Had heard about this a while back. Then nothing....
Thought it had gone away.
Bunch of damn candy-azz`es.
Funny part is. If they do beat HD. The lawyers will get a far bigger chunk of the award then any of their whine baby clients.
Little off topic but I was prescribed some arthritis meds by my doc bout ten years ago and I didn't take any and several years later received a letter from a law firm saying they were representing a class action lawsuit by and for people prescribed this arthritis med cause it caused all kinds of problems. I never sent them a letter back but followed the case.
Bottom line was the people who took meds and responded received... $ 5.63 cents each and the law firm received 28.5 million for their fee!
:grin
From reading the first link that was only dated last week it sounds like this was just a motion that filed by the MoCo to dismiss the suit and the federal judge ruled it could be continued.
It will be interesting to see if they can get the suit certified as class action. It's not that easy. If so, I have to wonder how many will register as part of the class.
So, you get 125,000 people to register as part of the class. (There's got to be well over a million eligible.)
The judgement is for $50 million against the MoCo.
Everyone gets $250 for a $20K motorcycle that allegedly is "not fit for their intended use" even though they have been riding it for the last 10 years.
I don't know whats wrong with judges and the excessive settlements they award , it only encourages ridiculous lawsuits like this one , I hope she owes money when it's over .
if the jury has any bikers the suit will fail. Fill the courtroom with bikers in the gallery, laugh during the defendants testimony on how he got a Boo Boo while riding with shorts on and had to have his mommy blow on it and kiss it to make it feel better.....and how it's Harley's fault he made a bad choice of clothing.
My Dad could have made millions for fuggin up his leg with a chainsaw....while wearing shorts......but he wasn't going to try to sue the chainsaw company for his poor decision.
I'm going to file a lawsuit because my Harley Davidson rattles at idle. LOL. Didn't those owner understand what they were buying?? Another case of "I'm too stupid for my own good and its someone else fault" in my opinion.
its not just the lawyers, its the judges that allow these frivulous suits to be allowed and judged in their courts. sad
smart judges will say, no. an dismiss it.
Hot motorcycle parts are a big problem. I felt really bad when a girlfriend burned her ankle on the exhaust of my '68 Bonneville. Even my KLX250 got too hot to touch. Why would anyone that that an air-cooled v-twin should not get hot?
Yeah, I remember a class action suit against a mortgage company. Can't remember why it was, but the lawyers got millions, everyone else got like a percentage point or two off their NEXT mortgage with the company.
My wife works in the court system, Some dumb A$$ wanted to sue Acme because she ALMOST slipped.
Thankfully the judge said no way and tossed the case out.
It's like suing boat manufacturers because boats are surrounded by dangerous water. Also love those multiple videos of fat women of throwing grapes on the grocer's floor then "slipping" and busting their butts. Bwahahahahaha!
