Just Got FIRED This Morning

to summarize: back in february the company was laying off, i volunteered to take TOWP{time off without pay} so someone else could keep their job.....employment security {ES} payed my salary up until the time of my crash{ 3 months}..during that 12 weeks i didn't pay into my LTD{long term disability} plan....my STD{short} ran out today........ring,ring ring,........hello, yeah this is Joe in HR, yer fired...............because i wasn't covered for those 3months that I VOLUNTEERED for...they cant pay my LTD so I'm no longer on the roster of employment.........no pay, no benefits,..........looks as if the rest of my recovery will be with out coverage, 20 years service with the same company and they throw me under the bus for 12 weeks that i THOUGHT was doing them a favor when they were in need............sorry for the rant, but i cant afford a shrink anymore, so you guys are my sounding board......hope my lawyer has a few tricks left.........thanks

If your company is over a certain amount of employees, (50) they should have had you fill out a Family Leave Act-1993 form, (and your doctor) to ensure your job and benefits.

Family and Medical Leave Act

Overview

Covered employers must grant an eligible employee up to a total of 12 workweeks of unpaid leave during any 12-month period for one or more of the following reasons:

*for the birth and care of the newborn child of the employee;
*for placement with the employee of a son or daughter for adoption or foster care;
*to care for an immediate family member (spouse, child, or parent) with a serious health condition; or
*to take medical leave when the employee is unable to work because of a serious health condition.

To be eligible for FMLA benefits, an employee must:
• work for a covered employer;
• have worked for the employer for a total of 12 months;
• have worked at least 1,250 hours over the previous 12 months; and
• work at a location in the United States or in any territory or possession of the United States where at least 50 employees are employed by the employer within 75 miles.

can't collect Dean, I'm unable to work and that's a condition of unemployment in NC............unable to work due to medical is reason they dont have to pay...........Dave, great idea man, i totally forgot about the FLA.....ill see what they say

If your company qaulifies, then HR dropped the ball and you *may* have been unjustly fired, if you had options.

Not positive about this, but maybe someone here that's in HR can help. KBOlsen is, I think.....

I believe Dave is right.....if you had options, they should have to fulfill those options. It's not like you were off work due to anything you did at the company.
